Terms of Service

Welcome to ProfitPulse, a service of Rockwell Industries ("we," "us"). By creating an account or using ProfitPulse you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility & Accounts

You must be at least 18 years old (or the age of legal capacity in your jurisdiction) to use ProfitPulse. You are responsible for safeguarding your account credentials and for every action taken under your account. Notify us immediately of any unauthorized use.

4. Subscription & Billing

Customer accounts are free. Operator accounts include a 14-day free trial; thereafter operators are billed on a recurring subscription per the pricing page. You may cancel at any time; cancellation takes effect at the end of the current billing period. We don't offer refunds for partial periods.

5. Connected Integrations

When you connect Gmail, Google Calendar, Stripe, Clover, Square, QuickBooks, or any other third-party service, you authorize ProfitPulse to access the data within the scopes you approve, only to deliver the in-app feature you enabled. You may revoke access at any time via Settings → Integrations or directly with the provider. The third party's own terms apply to data they hold.

6. AI features

ProfitPulse uses Anthropic Claude to power features such as menu photo parsing, inquiry email extraction, and ingredient impact summaries. AI output is provided as guidance and may contain errors. You are responsible for reviewing AI-generated content (e.g., parsed menu items, extracted inquiry fields) before relying on it. We do not allow our AI provider to use your data to train generalized models.

7. Your Content

You retain ownership of content you submit (menus, photos, customer data, etc.). You grant ProfitPulse a worldwide, royalty-free license to host, process, and display that content only as needed to operate the Service for you.

8. Customer-facing public surfaces

Operators agree that information they mark public (the inquiry form at /f/[slug], quotes sent via /q/[token], and the food-truck map presence) may be displayed to anyone with the link or who visits ProfitPulse's landing page.

9. Termination

You may terminate by deleting your account. We may suspend or terminate access if you breach these Terms, for security reasons, or to comply with law. Upon termination we delete your data subject to our retention policy in the Privacy Policy.

10. Disclaimers

ProfitPulse is provided "as is" and "as available." To the maximum extent permitted by law we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that pricing estimates, margin calculations, or AI-extracted fields are accurate; they are decision support only.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or USD $100, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.

12. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes are resolved in the state or federal courts located in Los Angeles County.

13. Changes

We may update these Terms. Material changes will be announced at least 14 days in advance for active accounts.
